PARTICIPANT RELEASE AND WAIVER AGREEMENT

This agreement affects your legal rights, please read it carefully

This agreement is between:

and Core Connection Studio LLC, Akiko Morison, Amanda Bauman, contractors, lessors and affiliated persons and organizations (collectively referred as “Core Connection Studio LLC”) in consideration for fitness instruction and the method created by Joseph H Pilates, I make the following statements and promises.

I acknowledge and agree that the activities in which I am about to engage involve physical activity which may from time to time be strenuous, and which carries the inherent risk of injury, including death.

I must;

1) judge my own capabilities with respect to participating in classes and other activities at Core Connection Studio LLC/ Akiko Morison/ Amanda Bauman and its’ contractors, lessors and affiliated persons and organizations (collectively referred as “Core Connection Studio LLC”) in consideration for fitness instruction. 

2) Consult with a qualified physician before beginning any exercise regime and from time to time thereafter pursuant to my physician’s recommendations. I hereby assume all risk of injury, illness, damage or loss to me or to my property that might result, including, without limitation, any loss or theft of any personal property. I acknowledge that it is my responsibility to inform Core Connection Studio LLC/ Akiko Morison/ Amanda Bauman and personnel immediately should an injury occur.

3) I understand that all reasonable efforts will be made to ensure my physical safety.

4) If I am Pregnant or if I become Pregnant, I will discontinue my training until I receive written consent from my doctor

In consideration of my participation in the classes/ training and use of the facilities and equipment located at Core Connection Studio LLC, I hereby

(1)  Waive and Release Core Connection Studio LLC and its Principal officer, owner, agent, employees, instructors, independent contractors and affiliates (collectively, Core Connection Studio LLC) from any and all Claims, demands, cause of action, damages, expenses (including attorney’s fees), losses and liabilities of any type whatsoever, past, present, or future arising out of or relating to my activities at Core Connection Studio LLC (collectively, “claims”)(excepting claims caused by grossly negligent, reckless or willful conduct, except to the extent such a waiver is permitted under law)  

2) Agree to indemnify and hold harmless the Core Connection Studio LLC, and it’s Principal officer, owner, agent, employees, instructors, independent contractors, affiliates and others.

3) Covenant Not To Sue: Core Connection Studio LLC, and it’s Principal officer, owner, agent, employees, instructors, independent contractors, affiliates and others, with respect to any claims. Foregoing waiver of claims, agreement to indemnify and covenant not to sue apply whether or not I am participating in a class using any equipment, or acting under the supervision of Core Connection personnel, at the time of any occurrence, act, or omission.

I am aware that there is a 24 hour cancellation policy and that I will be charged the full session fee for all late cancelled appointments.        

I understand that teachers are subject to change due to scheduling or emergencies, and that I am still responsible for keeping my appointments.  

We reserve the right to refuse service to anyone    

I understand that NO REFUNDS will be given on class packages. All unused sessions expire at the end of the month and that all classes are NON-TRANSFERABLE

I understand that all Private Training Packages expire in 120 days from date of purchase and that all sessions are NON-TRANSFERABLE

I hereby waive the protections of section 1542 of the California Civil Code, and any other stature or common law doctrine of the like effect, which provide that a general release does not extend to certain claims which the releasing party does not know or suspect to exist at the time of executing a release, it being my express wish that the foregoing release extend to include unknown and future claims. The foregoing agreements are expressly intended to”

(1) Extend to my heirs, executors administrators, legal representatives, assignees, and successors in interest

(2) Include injuries which may occur as a result of:

(a) The improper maintenance of any exercise equipment or facilities which may malfunction or break

(b) Core Connection Studio improper maintenance of any exercise equipment or facilities

(c)  Core Connection Studio negligent instruction or supervision

(d) My slipping and falling while on the premises 

(3) This waiver includes any claims arising out of or relating to occurrences, acts and omissions anywhere on the Core Connection Studio LLC, its ‘Principal officer, owner, agent, employees, instructors, independent contractors and affiliate, including without limitation the parking structure and the walkways between it and the Core Connection Studio facility.

I have carefully read, and fully understand and agree to each provision of the foregoing agreement.

For Participants under 18 years of age only:

I hereby represent and warrant to the Core Connection Studio LLC, it’s Principal officer, owner, agent, employees, instructors, independent contractors and affiliates, that I am the legal guardian of the above Participant and have the requisite authority to execute this agreement on behalf of the Participant. I agree to hold harmless each of the Core Connection Studio LLC, it’s Principal officer, owner, agent, employees, instructors, independent contractors and affiliates for any breach of the foregoing representations and warranties.
